Terms of Service

Your Body Audit provides general health education and information only. Everything we offer — our videos, articles, quiz, emails, live sessions, membership content, consultations, and any written summary or report — is for informational and educational purposes only and is not medical, pharmacy, nutritional, or professional healthcare advice.

We do not diagnose, treat, cure, prevent, or manage any medical condition. We do not prescribe, adjust, or advise you to start or stop any medication or supplement. We do not order laboratory tests or provide medical, pharmacy, or nutrition-therapy services.

Erik Welker holds a B.S. in Exercise Science and serves as a Health & Lifestyle Consultant. Jessica Welker holds a Doctor of Pharmacy (PharmD) degree. In providing these educational Services, neither is acting as your physician, your pharmacist, your dietitian, or your treating provider, and neither is practicing medicine, pharmacy, or dietetics.

Always seek the advice of your own physician, pharmacist, or other qualified healthcare provider with any questions about your health, medications, supplements, diet, or exercise. Never disregard professional medical advice, or delay seeking it, because of something you read, watched, or received from us. Do not start, stop, increase, decrease, or change any medication, supplement, diet, or exercise program based on our Services without first consulting your own physician.

If you think you may have a medical emergency, call 911 or your local emergency number immediately. The Services are not for emergencies.

Using the Services does not create a physician-patient, pharmacist-patient, dietitian-client, or any other professional healthcare relationship between you and Your Body Audit, Mountain View Media, LLC, or their owners. Any information we provide is general education you may choose to discuss with your own licensed providers, who remain solely responsible for your care and for all clinical decisions.

The Services are intended for adults. By using the Services, you represent and warrant that you are at least 18 years old and legally able to enter into these Terms. The Services are not directed to and should not be used by anyone under 18.

Our quiz and any "score" it produces are educational self-assessment tools only. They are not a diagnosis, a medical test, a screening instrument, or a measure of any medical condition, and they do not establish that anything is or is not wrong with your health. Your score is a general snapshot based solely on the answers you provide, and it should not be relied upon as a substitute for evaluation by your own healthcare provider.

Some Services are paid, including consultations, any written educational summary or report, and membership access. The specific terms of any paid service — including scope, price, and delivery — are set out in the separate agreement, invoice, or checkout terms you receive when you enroll, and those terms are incorporated into these Terms. If those terms conflict with these Terms, the service-specific terms control for that service.

Any written summary or report we provide is an educational document you keep and may choose to share with your own physician. It is not a medical record, a diagnosis, a treatment plan, or a prescription.

Because paid consultations and preparation begin promptly upon enrollment and are delivered as scheduled sessions, fees may be non-refundable once services begin, as described in your service agreement. Memberships bill on a recurring basis until cancelled; you may cancel at any time and cancellation takes effect at the end of the then-current billing period. Missed appointments and late cancellations may be treated as delivered sessions as described in your service agreement. Any laboratory testing is obtained by you, independently, through your own provider or a third-party lab service of your choosing; we do not order, require, or arrange it.

Health outcomes depend on many factors outside our control. We make no promise, representation, or guarantee of any particular result, improvement, or outcome. Individual results vary. Any examples or descriptions of potential benefits are illustrative only.

Physical activity, exercise, dietary changes, and other lifestyle changes carry inherent risks, including the risk of injury, illness, or aggravation of an existing condition. You should obtain clearance from your physician before beginning any new exercise or nutrition program, especially if you have any medical condition, take medication, or have any physical limitation.

By acting on any general educational information from the Services, you voluntarily assume all associated risks, agree that you are solely responsible for your own health decisions, and — to the maximum extent permitted by law — release Mountain View Media, LLC and its owners, members, and agents from claims arising out of those decisions.

You represent that any information you provide to us is accurate and complete, that you are providing it about yourself and not on behalf of another person without authority, and that you will promptly tell us if it changes. We are entitled to rely on the information you provide, and we are not responsible for outcomes resulting from incomplete or inaccurate information.

Any testimonials, examples, or scenarios shown are illustrative and reflect individual experiences that are not typical or guaranteed. Some examples are hypothetical and provided only to illustrate our approach.

You agree to use the Services only for lawful purposes and not to misuse, copy, scrape, resell, share access to, or attempt to reverse-engineer any part of our Services or content. You agree not to submit false information, impersonate anyone, interfere with the operation or security of the Services, or use the Services on behalf of anyone under 18. We may suspend or terminate your access at any time for violating these Terms.

All content on our Services — including videos, articles, graphics, logos, downloadable guides, the belt curriculum, quiz, reports, and other materials — is the property of Mountain View Media, LLC or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, publish, or create derivative works from any content without our prior written permission. Downloadable materials provided to members or clients are licensed for your personal, individual, non-commercial use only, and that license ends if your access is terminated.

If you send us feedback, ideas, or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

Our Services may reference, link to, or integrate with third-party tools and providers (for example, lab-testing services, scheduling and CRM platforms, payment processors, or affiliate partners). We are not responsible for the content, actions, data practices, or performance of any third party, and your use of a third-party service is governed by that third party's own terms and policies. We may earn a commission if you purchase through an affiliate link; where that is the case, we will disclose it.

To the maximum extent permitted by law, the Services and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any information will be complete or current.

To the maximum extent permitted by law, Mountain View Media, LLC and its owners, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, personal injury, or other loss arising out of or relating to your use of (or inability to use) the Services, your reliance on any educational information, or your health decisions — even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the specific service giving rise to the claim in the thirty (30) days preceding the claim, or (b) one hundred U.S. dollars ($100).

(Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.)

You agree to indemnify, defend, and hold harmless Mountain View Media, LLC and its owners, members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising out of your use or misuse of the Services, your violation of these Terms or any applicable law, your infringement of any third-party right, or your health decisions.

By providing your phone number and opting in, you consent to receive SMS text messages from Your Body Audit, which may include appointment confirmations, reminders, follow-ups, and updates. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for assistance. Carriers are not liable for delayed or undelivered messages.

If you participate in a phone consultation, we may record the call for quality, educational, and record-keeping purposes, and by proceeding with the call you consent to that recording. If you do not consent, tell us at the start of the call. Recordings are handled in accordance with our Privacy Policy.

We may update these Terms from time to time. Changes are effective when posted with a revised Effective Date, and your continued use of the Services after that date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. You and we agree that any dispute arising out of or relating to the Services or these Terms will be brought exclusively in the state or federal courts located in or serving Dawson County, Georgia, and you consent to personal jurisdiction and venue there. Before filing any claim, you agree to contact us at hello@yourbodyaudit.com and attempt to resolve the dispute informally for at least thirty (30) days.

To the maximum extent permitted by law, any claim must be brought within one (1) year after it arises, and each party waives any right to bring or participate in a class, collective, or representative action. (Dispute-resolution and arbitration terms are subject to final review by counsel.)

These Terms, together with our Privacy Policy and any service-specific agreement, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect and the unenforceable provision will be limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Sections relating to disclaimers, limitation of liability, indemnification, intellectual property, and governing law survive termination.
